Highway I-35 in Austin is a major roadway that runs north and south from Dallas into Austin and then south to San Antonio. From there it runs right into Nuevo Laredo on the Texas Mexico border. Because this is the main highway from Old Mexico into some of the largest cities in Texas, there’s a huge amount of traffic both day and night.
A new pilot program started by both the U.S. Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) permits Mexican trucks to cross the border and deliver goods in the United States. This program has taken a lot of fire from opponents because these Mexican trucks and their drivers are not required to pass the same rigid safety requirements as American trucks and drivers.
Their simple presence on I-35 adds greatly to the traffic congestion plus it does place many big rigs on the main highway running through Austin that aren’t safe. Mexican trucks can have bad brakes, worn tires and poor mechanical condition and may be driven by unskilled truckers who are not required to abide by FMCSA rules.
An accident with a Truck on I-35
Since these trucks are not required to follow all the same regulations as U.S. trucks, I-35 is seeing more car accidents and more severe injuries. Just within the last few weeks, a 7 vehicle pileup occurred on I-35 which killed one person and injured several others. The accident was caused by an18-wheeler. Witnesses said that the semi did not slow down when approaching an area where one lane was closed due to construction and motorists were slowing in order to merge. Instead of slowing down, the truck just plowed through, crashing into six cars causing one death and critical injuries.
In another recent accident on I-35, a semi broke down on railroad tracks at Walzem Road and was hit by a train. It instantly burst into flames, causing a nearby grass fire. Miraculously, there were no injuries but this accident closed the road for a period of time and cost the city and the railway thousands of dollars. It exemplifies the dangerous growing traffic problems that Austin residents must deal with.
If you or a family member has been involved in an auto accident on I-35 or around the Austin area, you could be looking at doctor bills, lost wages and lots of damage to your vehicle. Many Austin residents wonder whether they can recover all their losses if involved in an accident with one of these Mexican trucks. With insurance regulations and safety regulations so different for Mexico, motorists are understandably concerned.
In most cases, it is possible to go after the truck’s owner whether it’s an individual or a company. It is important to work with an experienced Austin law firm that has handled these types of cases in the past.
