Compensation Available in Wrongful Death Cases

Wrongful death suits can be brought against nearly any defendant, from individuals to corporations and even government entities and plaintiffs.  A person or group of family members successful in bringing a wrongful death claim may be awarded actual and exemplary damages. Actual damages can broken down into economic and non-economic damages, and include:

Economic Damages

  • Medical and funeral expenses
  • Loss of the deceased’s expected earnings
  • Loss of benefits stemming from the deceased, including medical coverage and pension plans
  • Loss of inheritance that the deceased individual would have saved to be passed down to the family if he or she had lived a normal life expectancy
  • Loss of the goods and services that the deceased would have provided
  • Loss of the deceased’s support, services, maintenance, care, and counsel that he or she would have provided to family members

Non-Economic Damages

  • Mental anguish, including emotional pain and suffering due to the death of your family member
  • Loss of care, protection, guidance, training, advice and nurturing
  • The loss of intangible benefits flowing from the deceased individual, such as comfort, love, companionship, and society
  • Loss of consortium from the deceased spouse

Exemplary damages, also known as punitive damages, are awarded to punish the wrongdoer and prevent future misconduct.  These damages are not available in every case.

If the wrongdoer has acted with recklessness or in an extremely egregious manner, the court may award these damages to make an example of the defendant. These damages can be quite large dependent upon the jurisdiction and the nature of the accident.

Additionally, in some cases, the plaintiff can seek compensation for interest and attorney’s fees. Interest can run from the time the damages were accrued, and attorney’s fees will include all reasonable fees extended in bringing the action.

Wrongful Death Damages Can be Hard to Calculate

As you can see from the variety of damages available and the many intangibles involved, it is difficult to calculate the specific award to which you may be entitled. Wrongful death cases will often require that parties obtain the assistance of expert witnesses, such as economists or accountants, who can offer their opinion as to damages.

These calculations will include not just tabulating income and savings, but also placing a dollar value on the care and services provided inside the home by the homemaker, such as child care, laundry, cooking, house cleaning, as well as education, medical care, and shopping.
