Pain and suffering are compensable damages that do not have an exact formula for calculation.  The calculation of pain and suffering damages is largely driven by the severity of the injury and the interruption the injury has caused to the victim’s life.  Pain and suffering damages are clearly greater for someone who loses a leg as opposed to someone suffers a soft tissue injury.  The venue in which the claim is made is also determinative of the value of pain and suffering damages.  Juries in conservative counties tend to give less for pain and suffering than their counterparts in liberal counties.  Before asking for an amount for pain and suffering, you should have a good understanding of the effects the injuries have had on your life and what a neutral third party would consider those effects to be worth.  You should also have an idea of what jury awards in the venue you will make the claim.
