By that I mean that until they've hit the age of majority - age 18 - they can't file a lawsuit. They can't hire an attorney on their behalf, so the parents actually need to hire the attorney and that parents actually have a claim as well. The parents' claim is for the medical bills, the economic damages. That's because the parents' responsibility is taking care of any bills that the child has until they're an adult. The child does have a claim, still. The child's claim, however, is for those non-economic damages: things like the impairment, disfigurement, pain, suffering, and mental toll an injury took.
