How do judges and juries determine the value of a non-economic loss in a personal injury case?
There is not a set formula for determining the value of non-economic losses. We present the evidence to the jury through witness testimony, medical records, photos, and anything else that will allow us to show the jury how your injuries have affected you. The jury has to use their experiences and judgment to collectively determine a value, although we may make suggestions in our arguments.
