If I get injured on the job, can I sue my employer?
In the State of Texas, employees that are covered under a Worker’s Compensation policy are prohibited from suing their employers for negligence for injuries suffered while on the job. If employers elect not to provide Worker’s Compensation, employees can sue their employers for negligence if they are injured on the job. In that scenario, employers cannot claim the defense of contributory negligence (i.e., the worker was also to blame for the injury).
