MOTORCYCLIST INJURED IN HIT AND RUN AT INTERSECTION IN AUSTIN, TEXAS

Our client was riding his motorcycle northbound on Pond Springs Road in Austin, Texas. At the same time, the defendant traveling westbound on San Felipe Boulevard was approaching a T-intersection with Pond Springs Road.

As the defendant approached the intersection, she was faced with a stop sign. Our client neared the T-intersection and did not have any traffic signal instructing him to stop or slow down, so he continued to proceed northbound.

As our client proceeded, the defendant did not yield the right-of-way to our client and pulled out in front of him, causing the collision.

The collision caused our client to flip and roll over the defendant’s vehicle for approximately 40 yards to the north of Pond Springs Road. The defendant proceeded to drive away without speaking to our client or exchanging any information – essentially, it was a hit and run.

After identifying the defendant, the case proceeded to litigation and was settled in favor of our client. Our attorney argued that the collision was caused because the defendant:

  • failed to yield the right-of-way when turning left;
  • maintained an unsafe distance from other vehicles;
  • kept an improper lookout;
  • made an untimely and improper application of her brakes;
