What can be recovered in a wrongful death case?

What can be recovered in a wrongful death case?

A wrongful death case in Texas limits the recovery to the children, the spouse, or the parents of the decedent. It also allows different damages that you typically have in a personal injury case. The first thing that we'd look at is financial losses. Those are the losses from the deceased of financial means, be it there wages, services that they've provided around the house, support they've provided to their family members, maintenance and care, and any kind of advice or counsel that that person provided to the family members. The next one we'd look at is mental anguish, which it any emotional pain, torment or suffering that you’ve experienced from the death of a family member. Then we want to examine what sorts of positive benefits that person provided to the family members, like love, comfort, and companionship. We also look at if there is an inheritance. Would the deceased, had they live their normal expected lifetime, left an inheritance to those individuals? Finally, if the person's death was caused by the defendant's willful act or omission, we may be able to recover exemplary damages in order to punish such severe conduct.
