The first thing to do when you are dealing with a potential brain injury case is to seek medical attention. How Does a Brain Injury Case Work?
A brain injury case can be confusing for those who have don’t have any kind of experience in the legal field. That is why a good first step in the process is to speak with an experienced lawyer in your area. A lawyer may be able to look at the details of your case and determine whether you have a legal claim at all. If you do, then they may be able to give you an idea of what it could be worth and what potential next steps might look like.

What Are the Elements of Negligence?

Legal Duty

Breach

Causation
After showing that the negligent party had a duty and ultimately breached that duty, the next step is to establish the causal link between that breach and the victim’s injuries. Even if someone breached a duty to act in a certain way, they may not be liable for damages if their breach didn’t actually cause the victim’s injuries.
Damages
Finally, in order to complete the process of proving negligence, a victim must show that they did, in fact, sustain injuries.
