Colorado Bicycle Accident Lawyers: Wrongful Death

Both the children and the surviving spouse have standing to bring a claim thereafter. If there is no spouse at the time of death, then the surviving children of the decedent may bring a claim at any time prior to the expiration of the statute of limitations. If there is no spouse and no children, then the parents of the decedent may bring a claim on behalf of their deceased child.


In Colorado, there is a two year statute of limitations on wrongful death claims. This means a claim must be brought within two years of the date of death.
