CALL (800) 863-5312 TODAY FOR A FREE CONSULTATION WITH AN EXPERIENCED NEW MEXICO ATTORNEY

Traumatic brain injuries (TBIs) can be life-threatening, and even when they aren’t, they can have devastating impacts on victims’ lives. Living with a brain injury or caring for someone who has received one as a result of an accident is certainly not easy. If you or a loved one has suffered a TBI, you know these struggles firsthand, and you should be compensated if the responsibility for the injury lies with someone else.

Brain injury survivors deserve the maximum compensation possible, and at Zinda Law Group it is our mission to help make that happen. To take advantage of a free consultation with one of our New Mexico attorneys, call (800) 863-5312.

BRAIN INJURIES EXPLAINED

According to the CDC, TBIs can be caused by bumps, blows, or jolts to the head, or from a “penetrating” injury to the head, like a gunshot. A brain injury can go by different names: traumatic brain injury, head trauma, concussion, brain damage, and so on. But, whatever the cause and whatever the type, these kinds of injuries can have devastating consequences.

Types of Brain Injuries

There are three primary types of brain injuries:

  • Concussions/Mild TBI’s: These are the most common type of brain injury, but that doesn’t mean they aren’t serious. Although they are called “mild,” that is just because they are usually not life-threatening. If you think you have a mild TBI or concussion, you may be entitled to damages, so you should call a New Mexico lawyer as soon as possible.
  • Moderate TBIs: Generally, moderate TBIs lead to long-term health problems, but on occasion they can lead to death. Even if they are not fatal, the resulting health problems can be excruciating. These types of injuries are even more difficult to manage and, most of the time, are even more costly.
  • Severe TBIs: As you may expect, severe TBIs can be extremely dangerous. When not fatal, they will generally cause long-term life effects that are described as being similar to the effects of a chronic disease. Severe TBIs can be extremely costly as they oftentimes will require hospitalization, job loss, and long-term medical care.

 Common Symptoms of a TBI

The symptoms of a brain injury may depend on the level of severity discussed above; however, some common symptoms that are experienced are:

  • Dizziness
  • Short-term memory loss
  • Nausea
  • Disorientation or confusion
  • Changes in vision or hearing
  • Headaches
  • Poor concentration
  • Difficulty sleeping
  • Slurred speech or trouble finding words
  • Depression
  • Irritability
  • Personality changes
  • Changes in appetite

If you have injured your head and are experiencing any of these symptoms, seek medical attention right away. This list is not exhaustive, so if your symptoms are not seen above, that does not mean you do not have a TBI. To be certain and “safe” rather than “sorry,” call our New Mexico attorneys.

Common Causes of TBIs

Unfortunately, brain injuries have many, many different causes. Below are listed a few common examples, but remember, if your head injury had a cause that is not listed, you should still call our New Mexico lawyers today.

  • Slips and falls: These are the most common cause in adults 65 and older.
  • Motor vehicle crashes: This is the most common cause for TBI in young adults.
  • Sports injuries
  • Falling objects while working
  • Being struck by objects
  • Blast injuries from explosions
  • Getting hit by a weapon of any kind
  • Child abuse
  • A head injury that causes a bone fragment to penetrate the skull

Diagnosis of a Traumatic Brain Injury

Generally, healthcare providers will ask you about your symptoms and how the injury occurred; afterward, they will perform a neurologic exam, and on occasion perform an imaging test, meaning a CT scan or MRI. If a provider believes you may have a brain injury, they may use a tool called the “Glasgow coma scale” to help determine how severe the injury is, or they may do neuropsychological tests.

If you have been in an accident or have hit your head and have since experienced symptoms common to these types of injuries, seek medical advice as soon as possible. Do not wait any longer, for if left untreated, brain injuries can be fatal.

Treatment of TBIs

The type of treatment survivors of TBIs receive generally will depend on the level of severity. On occasion, TBI survivors may need surgery to prevent additional damage to the brain; surgery may relieve pressure in the skull, repair fractures, or remove blood clots. Additionally, providers may prescribe medications, such as muscle relaxants or anticoagulants.

A very common type of treatment is rehabilitation therapy. This can help reduce physical, emotional, and cognitive difficulties. Rehabilitation therapy can be intensive and can require a lot of time and focus.

Whatever the treatment is that you receive, there is one thing that is for certain: it is expensive. That is why it is so important to call an experienced New Mexico attorney. A brain injury lawyer, like the ones at Zinda Law Group, can help make sure that you are adequately compensated for your medical bills and other related expenses.

Traumatic brain injury faqs

There are few injuries that are as complex as TBIs, so it makes sense that you or your loved one may have some important questions, like “What kind of compensation might I be entitled to?” or “Do I need a lawyer who has experience litigating a case involving a traumatic brain injury in New Mexico?” Below we have answered a few of these important questions for you, but remember, if you need more answers, our experienced New Mexico attorneys are only a phone call away.

What Kind of Compensation Might I Receive?

It is impossible to guarantee the amount of compensation that you may be entitled to, but generally a plaintiff in your position can recover two types of damages: economic damages and non-economic damages.

Economic damages cover the expenses that are easy for you to quantify, like your medical expenses. Typically, these types of damages will add up in these kinds of cases due to the extensive treatment that is required. Non-economic damages refer to less tangible costs, like the pain and suffering that you experienced or loss of consortium if you lost a loved one to a TBI.

If the wrongdoer in your case, AKA the person who was responsible for your injury, acted maliciously or fraudulently when they caused your injury, you may be entitled to punitive damages as well. These damages are intended to punish that person for their actions. Proving punitive damages, or any damage at all, can be difficult, which is another reason why it is beneficial to hire a New Mexico attorney.

Why Should I Hire a Brain Injury Lawyer?

From the moment a plaintiff files a brain injury lawsuit, the defendant’s insurance company will do everything in its power to discredit the injury and argue that it is non-existent or much less severe than it is. Fighting the insurance company on that front is not easy. Zinda Law Group, however, can take care of that headache for you.

Insurance company adjustors may try to claim that the medical testing you received was inconclusive or your diagnosis was incorrect. Our experienced brain injury lawyers know how to fight back against those inaccurate claims and ensure that you receive the compensation you deserve.

Moreover, in order to succeed in a brain injury lawsuit, you need to prove that the defendant–the person who caused your injury–was negligent. Proving negligence is not an easy task. Our experienced New Mexico attorneys know how to investigate these cases, prove the elements of the claim, and fight for the compensation you are entitled to.

This process can seem overwhelming, but we promise to guide you through every step of the way. We know firsthand how incredibly devastating these types of injuries can be, and we promise to do everything in our power to help you and your loved ones overcome it.

How Much Will It Cost Me Upfront to Hire Zinda Law Group?

This will be the most satisfying answer of the bunch: zero dollars! At Zinda Law Group, we know that you and your family have likely experienced immense financial hardship since the injury took place, which is why we promise to not charge you a dime unless we succeed in getting you the compensation you are entitled to.
