A common misunderstanding is that filing a police report is the same as or directly connected to making a claim to your insurance company. The police report serves as a record of the car accident, which can be used to your advantage in a claim. Police reports are not automatically sent in as an insurance claim. However, both your insurance company and the opposing party’s insurance provider may request a publicly available car accident report.

For small accidents like fender benders, it may seem unnecessary to get the police involved. In these cases, an officer may not want to waste their time attending to a matter that is not urgent, and it is in your best interest to file a report via mail or computer later that day.

When filing a police report, you want to include as many pieces in the following list as possible.
- Injuries to yourself and your passengers
- Description of events that led to the accident
- How many passengers were in each car
- Name and insurance information of other driver
- Witness names and a record of their account of the accident. Most smart phones have simple audio recording apps that can be used here.

In order to obtain a police report, you first must decide which law enforcement agency to contact and request the form from. Typically you will seek a car accident report from the police department in the city where the accident happened.
Next, determine whether that police department offers reports in print or online. In many cases, you will be able to fill out a form on your phone or computer, but that is not always the case.
If you would like a copy of the final police report, you will usually have to pay a fee to the police department. At Zinda Law Group, we handle those expenses, and you will only be billed for those fees if we win your case.
