Slip & Fall and Premises Liability Injuries
Everyone has had the misfortune of slipping or tripping, and while most of us were able to catch our balance or get back up without any problems, sometimes these slips, trips or falls can result in severe injuries. Hazards such as slippery floors, poor lighting, and uneven surfaces can cause a slip and fall. A slip and fall claim is often referred to as premises liability. It is a liability that is potentially created when a person slips, trips, or falls down on your property.
The claim must be based on the premise that the property owner was negligent in some manner that caused the slip and fall, such as allowing hazardous or dangerous conditions to exist on their property. Property owners are legally responsible for removing potential dangers that can cause injuries to others. This also applies to employers who have employees working on their property. If the property owner is aware of the danger or hazard, they can be held responsible for any injuries that occurred as a result of the dangerous or hazardous conditions.
I slipped and fell. Can I sue the property owner?
If you can prove the following six elements, then the answer to that question is “yes”. You must be able to prove all of the following elements:
- A condition existed that posed an unreasonable risk of harm
- The property owner knew, or should have known, that this condition posed a risk of harm
- The property owner should have anticipated that a person on their property could not have known about the risk or would be unable to protect themselves from the risk
- The property owner was negligent by failing to correct or alleviate the condition
- You were injured due to the property owner’s neglect
- The condition was a direct cause of your injury
