Available 24 / 7|Free ConsultationWhy Are Delivery Drivers More Likely to Cause Accidents?
There are many reasons why delivery drivers are more likely to get in car accidents. Some of the major causes are:
Age and Inexperience
Many restaurants and food chains hire young high schoolers or teenagers to work as their delivery drivers. Unfortunately, this means that many delivery drivers just got their licenses and have not had much experience on the roads; this lack of experience can make them more likely to make mistakes while driving, and their age makes them more susceptible to driving negligently without awareness of how serious the consequences can be. This factor, combined with all of the others, can be very dangerous; in fact, according to a study done by AAA, from 2010-2020, more than 120 people were killed on Colorado roadways in accidents involving teens.
Pressure to Rush
Not only are they young and inexperienced drivers, but pizza delivery drivers are also oftentimes pressured by their work to make deliveries as fast as possible. Restaurants and food chains want to maximize their profits, which means that they need to make as many deliveries as they can. Restaurants also want to keep their customers happy, which means they want to make their deliveries as fast as they can.
Young pizza delivery drivers may be worried about being fired from their first job or being reprimanded for being too slow; so, some make poor choices, like speeding or running through stop signs. Drivers also have pressure from the customers, too. Oftentimes the bulk of the driver’s take-home pay is what they make in tips, and they know that a delivery that is cold or took too long is not a great way to get tipped; thus, drivers have many incentives to rush and unfortunately, drive recklessly.
Inclement Weather
There’s no question that the best time to order pizza in Colorado Springs is on a rainy or snowy day when no one wants to leave the house to pick up dinner. However, this means that when the roads are at their worst, food delivery drivers are at their busiest; this can be extremely dangerous for inexperienced drivers who haven’t had very much time to get used to driving in the snow or rain. Additionally, these drivers are making deliveries to parts of the city that they have probably never been to; their lack of familiarity with the area makes the inclement weather and road conditions even more dangerous to the other drivers on the road.
Distractions While Driving
As discussed above, delivery drivers often go into neighborhoods that they have never been in, so they are heavily relying on their GPS to get them to the delivery spots. Additionally, when they are trying to find the residences, they may need to try to keep an eye out for house numbers, which can be an additional distraction; this is not to mention the fact that they may be fielding calls from the restaurant to check in on the delivery or tell them about new deliveries as well as calls from customers trying to figure out where their pizzas are. All of this, combined with the fact that younger drivers are more likely to be distracted by their phones, can be very dangerous.
Drowsy Driving
Whether the delivery driver just had a long day at school or at another job, or they’ve just been making deliveries for a few hours, they are likely to get drowsy at some point. Making deliveries as quickly as possible is exhausting for anyone, let alone for young drivers who haven’t had much experience driving for extended periods of time. Alarmingly, drowsy driving can be just as dangerous as driving under the influence; thus, it can definitely cause pizza delivery accidents in the Colorado Springs area.
These are just a few of the common causes of pizza delivery accidents in Colorado. If you were injured in an accident that was caused by something else, don’t let that stop you from calling one of our Colorado Springs pizza delivery accident lawyers. This list is not exhaustive, and you may still have a viable lawsuit.

Available 24 / 7|Free ConsultationWhich Insurance do I File a Claim With: the Driver’s or the Restaurant’s?
This is a great question, and sometimes the short answer is: both! Delivery drivers have to carry their own auto insurance, but the restaurants also have to have insurance regardless of whether the driver is using their own car or a company car. This means that if you get into an accident with a delivery driver, it is best practice to file a claim with both insurance companies. However, who is ultimately liable to you may depend, as discussed below.

Available 24 / 7|Free ConsultationWho is Liable for Pizza Delivery Accidents?
This is a really important question with a very complicated answer. You may be thinking, “Isn’t the other driver the one liable?” In most circumstances, that is true, but sometimes there may be other individuals or entities that are liable as well.
The most common example of this is the restaurant itself. If the delivery driver was in fact on the job when the accident occurred, this means that it took place during the scope of his or her employment, and the restaurant can therefore be found vicariously liable for the driver’s negligence.
Restaurants should be held responsible for failing to properly supervise their drivers or for negligently hiring drivers who are too inexperienced or otherwise ill-fitted for the job. For example, say a restaurant chooses to hire a delivery driver but doesn’t look at that person’s driving record. As it turns out, that person has a lengthy record of driving infractions, and he causes an accident on his first day of the job; in that case, the restaurant was negligent in failing to properly vet their employee and should therefore be held liable for the injured party’s harm.
On occasion, there may be other responsible parties instead or in addition to the other driver and his or her employer. Say the accident was caused because the other driver’s brakes malfunctioned, or because the city failed to pick up after a construction site on I-25. In those cases, the manufacturer of the brakes and the city could be considered as possible defendants.
In order to best set yourself up for receiving compensation you should try to plead as many arguments against as many defendants as you can. However, figuring out who was responsible and how you can prove it is not an easy task; at Zinda Law Group, our Colorado Springs injury lawyers are experienced in these kinds of cases and can take care of that challenge for you.

Available 24 / 7|Free ConsultationWhat Kind of Lawsuit Would I Bring?
This is also a great question with the similar answer of, it depends! Sometimes plaintiffs that are injured in a pizza delivery accident have negligence causes of action; at other times plaintiffs may have a claim of wrongful death or strict liability.
What legal claim or claims you can assert will depend on your specific circumstances, for each claim has different elements that need to be proven. For example, a claim of negligence requires the plaintiff to prove four elements: duty, breach, causation, and damages; can you prove all four of these elements by yourself? This is one of the many reasons why it is so important to hire an experienced Colorado Springs personal injury lawyer; your lawyer can listen to your story, figure out what type of lawsuit you can bring, and help you prove the necessary elements.
What Kind of Compensation Would I Receive?
It’s impossible to say the exact amount of compensation that you may be awarded, but generally plaintiffs will receive economic damages and non-economic damages. Depending on the type of lawsuit you bring, your damages may include compensation for expenses you would not ordinarily think to ask for. For example, in a wrongful death action, you can receive compensation for funeral costs and burial expenses.
Economic damages typically cover costs like your medical expenses, property damage, and wages for the time you missed from work while recovering or going to doctor appointments. Non-economic damages cover more abstract costs, like your pain and suffering. In order to receive the maximum amount of compensation possible in court, you need to prove that you have suffered these costs. This isn’t always easy, which is another reason why it is so important to have a Colorado Springs injury attorney by your side.
What Are Common Injuries from Pizza Delivery Accidents?
Car accidents can cause many different kinds of injuries, but some common injuries are:
- Bruises, burns, and lacerations
- Fractures and broken bones
- Internal organ damage
- Neck injuries
- Nerve damage
- Post-traumatic Stress Disorder (PTSD)
- Scarring and disfigurement
- Soft tissue injuries
- Spinal cord injuries
- Traumatic brain injuries and concussions
- Whiplash
Even if your injury is not listed above, that does not mean you don’t have a possible legal claim. To talk more about your injury and how you may be compensated for your harm, call one of our Colorado Springs injury lawyers.

3 IMPORTANT STEPS TO TAKE AFTER A PIZZA DELIVERY ACCIDENT IN COLORADO SPRINGS
We wish we could turn back time and stop the accident from happening, but unfortunately all we can do is guide you on what to do after an accident to best prepare yourself for your physical and financial recovery.
Call the Police and Say “Yes” to Medical Attention.
Even if the other driver is a young teenager who made a mistake while delivering pizza, you should always call the police to the scene; it may be tempting to handle it on your own so that the other driver won’t “get in trouble,” but calling the police will in the end benefit you both. When the Colorado Springs police arrive, they will fill out ; this report will be very helpful to your case later on.
Generally medical personnel will also arrive to the scene with the police; you should always say “yes” to getting checked out by a medical professional. Sometimes you may not notice injuries at first because you are in shock, but if left untreated, they can progress and become very dangerous.
Document Everything.
If you can, start documenting everything you can at the scene: Take pictures of the vehicles, write down the names and contact information of the other driver and any witnesses on the scene, and take pictures of your injuries or property damage. You can even start a journal or diary where you keep track of your recovery process and the hardships along the way, like your days off of work. Sometimes later on it can be hard to remember all the struggles you went through, so a journal will be very helpful to your case and your attorney.
