Liability in an Albuquerque Rideshare Accident

Drivers for the big rideshare companies work as independent contractors rather than employees. This distinction allows these companies to limit the benefits and protections they extend to their drivers. This can make it difficult to recover the compensation you need and deserve after an accident.

While rideshare companies are required to carry insurance, the level at which their policy kicks in depends on the circumstances of the accident. Furthermore, these companies require their drivers to carry personal car insurance, which serves as the first source of compensation after any accident.

Driver Has Not Signed into the App

If a rideshare driver is involved in an accident while they are not signed into the rideshare app, the rideshare company does not hold any liability for damages incurred.

Driver Has Signed into the App But Hasn’t Accepted a Ride

Under these circumstances, the rideshare company will have limited liability. For the injured party, the first source of compensation will be to file a claim with the driver’s insurance provider. If your damages exceed the coverage limits of the insurance plan, you can also file a claim with the rideshare company’s insurance.

However, the coverage limits under this policy are limited in this situation, and you may still need to file a lawsuit to recover the full amount to which you are entitled.

Driver Has Signed into the App and Has Accepted a Ride

In this situation, the full coverage of the rideshare company’s insurance policy comes into effect. Once again, your first option for recovering compensation will be through the driver’s insurance policy. However, if your damages exceed the coverage limits, you can recover up to $1,000,000 in damages from the rideshare company’s policy.

If your damages are incredibly severe and exceed this coverage limit or if the insurance company is contesting your claim, you can file a lawsuit to recover the full amount to which you are entitled.

Time Limit for Submitting a Rideshare Accident Lawsuit in New Mexico
