Colorado gives you two years from your accident date to file a lawsuit. Miss that deadline and your case dies. Permanently. Even if you have the strongest case in the world. Wrongful death claims also have two-year deadlines.
Some exceptions exist for minors or delayed-discovery situations. A lawyer can tell you your exact deadline. But waiting until you’re running out of time is risky.
Shared Blame Reduces What You Get
Colorado uses modified comparative negligence. That means if you’re partly at fault, your compensation gets reduced by your percentage of blame. But there’s a cutoff: if you’re 50% or more at fault, you get nothing.
Example: Jury awards you $200,000. They decide you’re 30% to blame. You get $140,000. If they decide you’re 50% or more to blame, you get zero.
