The Texas wrongful death statute in a Houston case
The Texas wrongful death statute is chapter 71 of the Texas Civil Practice and Remedies Code. It lets a family sue when a death was caused by another person’s wrongful act, neglect, carelessness, unskillfulness or default. The same law applies in Houston as anywhere else in Texas. The claim exists only if your loved one could have sued for the injury had they lived. So a defense against that claim can be raised against the family too. That includes their own share of fault.
Which family members can file a wrongful death lawsuit
Under Texas law, the wrongful death claim belongs to the surviving spouse, the children and the parents. A single one of them can sue for the whole group. Grandparents and siblings cannot bring it.
If none of them files within three calendar months of the death, the executor or administrator of the estate must file the wrongful death action. The exception is when all of them ask the representative not to.

At trial, the jury divides the award among those family members in the shares it finds. Creditors of the estate cannot reach that money.
The survival claim in a Houston case
A Houston family can have two claims after one wrongful act. The wrongful death claim compensates surviving family members for their own loss. The survival claim, also called a survival action, belongs to the estate. It covers what your loved one could have recovered for the injury had they lived, such as their pain before death and their medical expenses.
The two claims can run side by side in one wrongful death lawsuit. They pay different people. That matters when the estate owes money, since the family’s wrongful death claims are protected from those debts.

Damages a Houston family can recover
Texas law lets family members recover damages in an amount proportionate to the injury the death caused. That wrongful death compensation falls into three groups. Each has its own rules.
Economic damages
Economic damages are the losses with a price. They include the lost income and support your loved one would have provided and the inheritance the family members would have received. The survival claim adds the medical expenses from the final injury. Funeral costs and burial expenses can be recovered too.
Non economic damages
Non economic damages cover the loss that no bill shows. Texas courts allow damages for mental anguish, the law’s term for emotional suffering, and for the loss of companionship and society. For a parent who lost a child, or a spouse who lost a partner, this is the loss a jury is asked to measure.

Exemplary damages
Exemplary damages, often called punitive damages, punish a defendant for a willful act or gross negligence. To win them, the family must prove it by clear and convincing evidence. The jury must agree unanimously.
Texas caps exemplary damages for most defendants, measured against the economic and non economic damages. The cap does not apply when the claim rests on conduct the statute lists as a felony, such as intoxication manslaughter.
Where to file a wrongful death lawsuit in Houston
A Texas personal injury or wrongful death lawsuit is generally filed in the county where all or a substantial part of the events happened. A case can also be filed in the county where an individual defendant lived, or in the county of a company defendant’s principal office in Texas. Harris County district courts
As of September 2026, Harris County has 27 civil district courts. All of them sit in the Civil Courthouse at 201 Caroline in downtown Houston. Larger personal injury and wrongful death cases are heard there.
When a wrongful death suit goes to federal court
Some wrongful death lawsuits belong in federal court, for example when the parties are from different states. A federal case from Harris County goes to the Houston Division of the U.S. District Court for the Southern District of Texas. Which court fits depends on the parties and the claims. A death caused by a city truck or by dangerous public property can lead to a claim against a government entity. Those wrongful death claims follow the Texas Tort Claims Act. They run on different rules.
Texas makes a government unit liable for a death caused by an employee’s use of a motor vehicle or motor-driven equipment. It also covers deaths caused by a condition or use of tangible property.
The law caps what a city or a county can be made to pay, and it requires notice of the claim far sooner than the deadline to file a wrongful death lawsuit. A city may set a different notice period in its charter. Surviving family members can seek financial compensation from a city or county only within those limits.

Texas uses proportionate responsibility. What surviving family members recover is reduced by that share of fault, and it ends if the share is more than 50 percent. A smaller share only lowers what the negligent party pays.
