Xarelto Lawsuits: Time Frame for Filing Claims
Approved in 2011, the drug Xarelto (rivaroxaban) is a blood thinner manufactured by Bayer and marketed by Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson. The drug was initially marketed as an improved version of earlier blood thinners that had a number food and drug interactions.
However, new evidence has emerged that Xarelto is a dangerous drug that causes a number of serious and even life threatening complications. In response to the number of injuries and deaths linked to the drug, various lawsuits have emerged against Bayer and Janssen.
Xarelto lawsuits are being filed against Bayer Healthcare and Janssen Pharmaceutical alleging that these companies failed to warn patients as to the increased risks of serious and potentially fatal internal bleeding when using Xarelto.
The lawsuits state that had Xarelto warned patients of the risks, patients and their physicians would instead have prescribed the drug Warfarin, an older blood thinner that in the event of internal bleeding can be treated with high doses of Vitamin K.
What is Xarelto and Why is it Prescribed?
Xarelto is a blood thinner prescribed to prevent clots in those that suffer a number of conditions, including:
- Pulmonary embolism (clots in the lungs)
- Atrial fibrillation (arrhythmia in the heart)
- Deep vein thrombosis (clots in the body)
- Patients who have undergone hip or knee surgery
Xarelto is generally prescribed as an alternative to the older blood thinner drug Warfarin.
Xarelto Risks and Side Effects
The most serious side effect now directly linked to Xarelto is severe internal bleeding that can result in death. Currently, there is not an antidote to reverse the internal bleeding that can result from the use of Xarelto. Other potential injuries include:
- Dyspnea or difficulty breathing
- Peripheral edema
- Decreased hemoglobin
- Cerebrovascular accidents
Xarelto Litigation is Just Getting Started
At this time, there has not been a recall of the drug Xarelto and lawsuits are still in their infancy. A number of suits have been filed and are in the discovery phase. Lawsuits of this magnitude can take time to resolve with similar suits generally being lumped into class actions.
You Have a Limited Time Within Which To File So Consult with An Attorney As Soon as Possible
Each state has a statute of limitations that restricts the time period that a person can file a lawsuit. Statutes of limitations vary by state and by cause of action. If you fail to file your lawsuit within the applicable statute of limitations, you risk losing your right to recovery permanently.
In Texas, all cases based on the danger or defectiveness of a drug must be brought within two years after the plaintiff suffers injury. Accordingly, the clock will begin to toll as soon as you experience the injury, which can be some time before you discover the reason for the injury. As such, consult with an attorney as soon as possible if you are taking Xarelto and have experienced any sort of injury.
