Allstate, just like many of the other major insurance companies, is a multi-billion-dollar corporation. The business made its fortune by selling as many insurance policies as possible and then paying the smallest amount possible on their claims.
To allegedly combat fraud, Allstate uses an approach called “deny, delay, and defend” on what they believe are lower impact collisions. That motto is a pretty accurate description of how all insurance companies operate. Using this approach increases their profits. When you file a claim with Allstate, the odds are that they will want you to give a recorded statement. It is rarely beneficial to give a recorded statement, and often it can work against you. If you leave out a small detail, remember things a little differently later, or your pain increases over the next few days, Allstate can use those discrepancies to your disadvantage. Whatever you say in those recorded statements can be used against you later.
The best route is to refrain from giving a recorded statement. Usually, the information they are wanting can be found in the crash report. If you do talk to the claim adjuster before obtaining legal representation, the best thing to do is keep your conversation focused on the logistics of getting your vehicle repaired or getting your vehicle paid for. You should not discuss the details of your injuries, though if Allstate is your insurance company, you may be required to give a recorded statement under the “cooperation clause” of your policy.
Another thing to keep in mind is that if the at-fault driver who injured you is covered by Allstate, the company will not pay your medical bills or reimburse you for lost wages along the way. If Allstate makes you any offer at all, usually it will be a low-ball offer, and they will want you to sign a document that releases your entire injury claim.
