The second way in which you can be successful in these types of cases is something called negligent handling. That just means that the owner or the possessor handled the dog in a way that a reasonable person under the circumstances would not have.
The last way in which you can hold somebody responsible that owns or possessed a dog is something called negligence per se. That’s typically going to be a violation of an ordinance or a statue or a law that because it was violated, automatically means that they were negligent. Typically what you’re looking at here is for a leash law that was violated. Find out if a leash law applied and then you’re able to bring a negligence per se cause of action against the owner and possessor if it was violated.
