Federal Safety Standards
The federal government has specific safety standards in place for commercial vehicle drivers. If you are involved in a trucking accident and the driver was not following the following standards, the driver may be held liable for any resulting injuries and property damage.
Commercial vehicle drivers who are required to obtain a commercial driver’s license (CDL) are also required to be alcohol and drug tested by their employer. Federal law prohibits the on-duty use of drugs and alcohol. Further, drivers are forbidden from performing safety-sensitive functions within 4 hours after ingesting alcohol.
There are limits to the number of hours that a commercial vehicle driver can be on-duty and driving; for example, after being on duty for 15 hours, and after following 8 consecutive hours off duty, the driver of a commercial vehicle with passengers cannot drive for any additional amount of time. These individuals may be able to do other work, however. Driving limits are put into place in order to keep fatigued commercial drivers off of the road.
Additional Colorado Safety Standards
Colorado has also implemented additional standards in order to keep their roads safe. Examples of these regulations include:
Vehicle Lengths. There is no federal limit on most truck tractor-semitrailers operating on the National Highway System. However, under Colorado law, there is a 45-foot maximum on overall single vehicle lengths and a 70-foot combination length on all roads.
